Terms of service

1. Who we are. This site is operated by The Well Build Standard LLC, DBA The Well Build™ ("we", "us"), 191 Main St #543, Port Washington, NY 11050. By using this site or buying from us, you agree to these terms.

2. Educational and advisory purpose. Everything we publish and sell — guides, webinars, specifications and consulting advice — is educational and advisory. We are not licensed contractors, architects, engineers or building inspectors. We do not design, engineer, manage, supervise or direct construction, and we do not perform code or structural inspections.

3. Licensed professional review is required. Any recommendation we give must be reviewed and approved by your own licensed contractor, architect or engineer before it is acted on. Do not rely solely on our advice for any construction, renovation or remediation decision. Our work supplements the judgement of licensed professionals; it does not replace it.

4. No warranties. Our services and products are provided on an "as is" basis. We make no warranties or guarantees, express or implied, about health outcomes, the effectiveness of any strategy, the absence of mould, moisture, VOCs or EMFs during or after construction, or the performance of any material or system.

5. Limitation of liability. Our total liability for any claim relating to our products or services is limited to the amount you paid us. We are not liable for indirect, incidental, consequential, special or punitive damages, including construction delays, cost overruns, property damage, loss of property value, medical costs or loss of use. We are not responsible for the acts or omissions of your builder, contractors, architects, engineers or other third parties, even where they act on our advisory feedback. Any claim must be brought within one year of the services giving rise to it.

6. Digital products and licence. Purchasing a digital product grants you a personal, non-transferable licence to use it for your own project. All guides, specifications, reports and other materials remain our property. You may share them with your own builder and licensed professionals for your project. You may not resell, republish or distribute them otherwise.

7. Consulting engagements. Consulting services are provided under a separate written agreement signed by both parties. Where that agreement and these terms conflict, the signed agreement controls.

8. Affiliate links. Some product links on this site are affiliate or discount links, and we may earn a commission if you buy through them. We only recommend products we have used ourselves or specified on client projects.

9. Purchases and refunds. Prices are in US dollars and may change. Our Refund Policy and Shipping Policy form part of these terms.

10. Governing law. These terms are governed by the laws of the State of New York. Any dispute will first be addressed through good-faith mediation in Nassau County, New York, and if unresolved, through binding arbitration administered by the American Arbitration Association in Nassau County, New York.

11. Changes. We may update these terms; the current version always appears on this page.
